LASTING POWERS OF ATTORNEY | 31st Dec 2008
Enduring Powers of Attorney (EPAs) have been radically changed as a result of the Mental Capacity Act 2005. From 1st October 2007 EPA’s have been replaced by Lasting Powers of Attorney (LPAs).

An EPA signed before 1st October 2007 will still be valid; however it is not now possible to sign a valid EPA, (although general non-capacity related attorneys can still be granted).

The LPAs come in two parts. One part deals with financial affairs, as before, whereas the other part deals with entrusting important decisions concerning care and treatment to an appropriate person.

As with the EPA, it is vital that the donor trusts implicitly the person to whom they are giving the power.

Unfortunately an LPA is more expensive to set up and register than an EPA because with an LPA the documentation is greater in volume and it has to be registered as soon as it is signed to be valid and the registration fee paid - currently £120.00.

Our current charges for a single LPA are £250.00 plus VAT and £450.00 plus VAT for both. Our charges for registering a single LPA are £250.00 plus VAT and £300.00 plus VAT for both and we are happy to see clients at their home if they are unable to visit our offices.
